Complaint

The IFA complaint was that Mr Gobikrishna, as director and sole person of significant control of Riya Financial Solutions Limited, had failed to provide evidence of completed AML training for all relevant employees and failed to complete client risk assessments for all clients by the agreed deadline, in breach of MLR 2017 Regulation 24, 27 – 28 and 66. In addition, he failed to make available to the Institute a written alternate agreement when requested in breach of the IFAs Public Practice Regulation 11.9.

Finding

The Regulatory Committee found that there was a prima facie case to answer that rendered Mr Gobikrishna liable to disciplinary action under IFA Bye-law 11.2 (c) and (d).

Consent Order

Severe Reprimands, reprimand, fine of £3500 and costs of £1220.
